WOMADelaide 2017 Competition – Terms and Conditions

Womadelaide Competition

Participation in the Competition is subject to the following terms and conditions (the Rules). By entering into the Competition you agree to be bound by these Rules. If you do not accept the Rules, you should immediately withdraw from the Competition.

THE RULES

PROMOTER’S DETAILS

The Promoter is Suntrix (ABN 94 971 811 561) of 95 Graves Street, Newton SA 5074 (Promoter)

WHO CAN ENTER

The competition is open to residents in South Australia aged 18 years or over except employees of the Promoter, their immediate family members and anyone otherwise connected with the Promoter.

HOW TO ENTER

To enter this competition entrants must follow the instructions provided in either the competition announcement on www.facebook.com/suntrixsolar or the email communication from the Promoter to its Customers. Only one entry will be accepted per person. Multiple entries from the same person will be disqualified. The closing date for entry will be February 28. Entries received after this date will be invalid. No responsibility will be accepted for entries not received for whatever reason. Entry in the Competition is free excluding internet connection charges.

HOW TO WIN

A winner will be randomly selected and notified by Facebook or email within 7 days of the closing date. If the winner cannot be contacted or does not claim the prize within 2 working days of notification, the Promoter reserves the right to withdraw the prize from the winner and pick a replacement winner. The Promoter reserves the right, at any time, to verify the validity of entries and entrants and to disqualify any entrant who submits an entry that is not in accordance with these Rules or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

The Promoter’s decision in respect of all matters to do with the Competition will be final and no correspondence will be entered into.

THE PRIZE

There is one prize to be won as part of the Competition. The winning entrant will receive 2 passes to attend WOMADelaide on Friday, March 10. The prize is as stated and is not transferable, exchangeable or redeemable for cash. The Promoter will not be liable in the event that the winning entrant does not take, or is unable to use the prize or any portion of it for any reason.

In participating in the Competition, the winning entrant agrees to participate and cooperate as required in all editorial and media/PR activities relating to the Competition, including to be interviews and photographed. The winning entrant authorizes the Promoter to use such footage and photographs together with  the winner’s name, voice, video entry, image and likeness for advertising and publicity purposes in any media in perpetuity worldwide without additional compensation or further reference to the winner.

RELEASE AND INDEMNITY

To the extent permitted by law, all entrants release from, and indemnify the Promoter against all liability, cost, loss or expense arising out of acceptance of any prize(s) or participation in the Promotion including (but not limited to) loss of income, loss of opportunity, personal injury and damage to property, whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.

The Promoter reserves the right to cancel or amend the competition and these Rules without notice. Any changes to the competition will be notified to entrants as soon as possible by the Promoter.

This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. All entrants unconditionally and irrevocably release and discharge Facebook from any and all liability in relation to this Promotion.

If for any reason, the Competition is not capable of running as planned (including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Competition), the Promoter reserves the right, in its sole discretion, to disqualify any entrant who undermines the fairness of the competition (by, for example, tampering with, or using or exploiting errors in, the entry process to obtain a competitive advantage over other entrants), to take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to any direction given under state regulations, or any written directions given by a relevant regulatory authority.

Once the prize has left the Promoter’s premises, the Promoter and its associated agencies take no responsibility for the prize being damaged, stolen or lost.

The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these terms and conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

By entering and participating, entrant agrees to hold harmless, defend and indemnify Facebook from and against any and all claims, demands, liability, damages or causes of action (however named or described), losses, costs or expenses, with respect to or arising out of or related to (i) entrant’s participation in the Sweepstake, or (ii) entrant’s participation in any Prize related activities, acceptance of a Prize and/or use or misuse of a Prize (including, without limitation, any property loss, damage, personal injury or death caused to any person(s).
